In addition to the "General Terms and Conditions" of Bank Winter & Co. AG the following special terms and conditions apply for e-Banking via Internet:

1. General information/requirements/participation
The participation agreement for Bank Winter e-Banking via Internet regulates the current scope of services.
Bank Winter e-Banking via Internet enables a customer - by entering his/her personal identification details ("Verfuegernummer" = user identification, "Verfuegername" = user name, PIN = personal identification number and if applicable TAN = transaction number) - to process transactions for predefined accounts, to authorize domestic, standing or direct debit orders for accounts of which the customer is either the holder or an authorized signatory, to check his/her account (scan the account data) and to retrieve account statements.
For customers being not the holder or authorized signatory, the access through Bank Winter eBanking is limited to calling up account information and to retrieving account statements.
For using Bank Winter e-Banking via Internet an account at Bank Winter is required. Every holder of a Bank Winter account or any other person authorized by the holder is entitled to use Bank Winter e-Banking after signing the participation agreement. A user who is not authorized signatory only receives limited access (see above).

2. Access authorization/processing
For a secure access to Bank Winter e-Banking via Internet each user receives the following personal identification details from Bank Winter: - "Verfuegernummer" = user identification - PIN = personal identification number, password for first access Additionally each user has to define a "Verfuegername" = user name.
To conduct transactions the user also needs a transaction number (iTAN, mobile TAN) which may only be used once.
For the mobile TAN system the customer has to forward a mobile telephone number to the bank. The mobile TAN necessary to sign an entered transaction will be sent via SMS which will also include information on the transaction. The user is obliged to verify this information and enter the mobile TAN only in case of accuracy.
The user has to take care that all contractual agreements with his mobile communications provider and all technical requirements for the receipt of SMS with a mobile TAN are met. He/she must also take into account that the receipt of a SMS is only possible in areas with sufficient network coverage.
The customer can change the mobile telephone number directly through Bank Winter eBanking via Internet and sign the order by mobile TAN which will be sent to the originally given number. Alternatively the customer may also change the number personally at Bank Winter.
By special order of the user a list of TANs may be created and forwarded to the user by Bank Winter.
Delivery of access data and TAN lists is made personally at Bank Winter or if explicitly requested by post.
The customer's authorization to access Bank Winter e-Banking is always verified exclusively on the basis of the personal identification details (user number and name, PIN). For transactions the user also needs a TAN to prove authorization. The account holder has to define the range of authorizations for each user within the participation agreement. The authorization to sign orders is only granted to the account holder or an authorized signatory (according to the list of authorized signatories). The regulations regarding sole and joint authorization are also applicable for orders through Bank Winter e-Banking via Internet. The bank has the right to change the procedure of authorizing access with prior notice. Furthermore the bank reserves the right to change the range of services offered within Bank Winter e-Banking via Internet.

3. Due care
The customer receives his personal identification details and TANs from Bank Winter upon request. He/She must keep those details secret and in no case forward them to third parties. The PIN has to be changed on a regular basis, at least after two months. The customer is obliged to exercise due caution regarding his personal identification details and TANs (which must in no case be disclosed to any other persons) in order to avoid misuse. He/she has to particularly take care that when using the personal identification details nobody can spy them out. To make sure that the customer is connected to the bank, we recommend verifying the certificate information of the Secure Socket Layer (SSL) coding regarding the following content: owner - www.banking.co.at, issuer - www.verisign.com.
Furthermore we advise to follow the instructions regarding use and security within the current application. Besides the customer is obliged to verify the accuracy of all transactions on his/her account. Additionally we suggest that the customer takes technical measures to protect his/her computer, especially to use a firewall and an updated virus scanner.

4. Blocking
The access to Bank Winter e-Banking via Internet will be automatically blocked if an incorrect personal identification detail or TAN is entered four times in succession. When misuse is suspected the bank is entitled to block the entire access to Bank Winter e-Banking via Internet or only limited to certain services. In case of loss of personal identification details or TANs and/or if suspected that any other persons have gained knowledge of this information as well as in any other circumstances, which enable a third party to misuse the system, every user has to change his/her PIN immediately and to arrange a blocking of access by calling his account manager at Bank Winter. He/She has to prove identity by giving his/her name, user identification and account number. With effectiveness of the blocking the bank is liable for any damages occurring due to a disregard.
This block can only be lifted by way of a written request from the customer, personally by visiting Bank Winter or on the phone giving the account manager a valid TAN.

5. Valid disposals
Valid disposals of the authorized user, which are terminated by entering a valid TAN (e.g. orders), are considered to be submit as soon as the customer terminates the transaction by entering a valid TAN. The TAN loses validity. When submitting orders please consider the current closing times on workdays, which are Monday to Thursday 3.00 p.m. and Friday 2.00 p.m.

6. Liabilty
The account holder is not liable for any damages occurring due to disregard of these special terms and conditions as long as he is not proven any fault. If the account holder disposes his/her personal identification details to a third person or if a third person gains knowledge of these personal identification details due to a violation of the account holder's duty of care, the account holder is liable for any damages and consequences caused by misuse until the blocking (par. 4) is effective. As soon as the blocking is effective the account holder is no longer liable. If the account holder is liable, his liability also includes damages caused by the disregard of these special terms and condition by any other person authorized to use e-Banking via Internet for this specific account. For any damages concerning the hard- and software of the customer or rising due to a failure of connectivity to the data processing centre the bank is only liable in case of culpability. The bank's liability for damages caused by defective technical equipment used for the data processing is limited to EUR 5,000.00 per customer and EUR 100,000.00 in total. If the total damage exceeds this limit, the claims for compensation of each customer will be reduced proportionally.

7. Cancellation
Every customer may terminate the participation in Bank Winter e-Banking via Internet at any time, without giving reasons and without a notice period in writing. Upon receipt of the cancellation the bank will block the access through Bank Winter e-Banking via Internet. For cause the bank is entitled to cancel the authorization to use Bank Winter e-Banking via Internet with immediate effect. Transactions already in process are unaffected.
